Peltier has been imprisoned for more than 48 years, with dozens of members of Congress urging his release. Peltier, 79, has maintained his innocence throughout his time in prison.

"Joseph seeks a pardon for #StevenDonziger, an environmental and human rights attorney. Donziger won a $9.5 billion judgement against Chevron in an environmental lawsuit in Ecuador. He was sentenced to six months in jail in 2023 for failing to comply with a judge’s order to surrender all of his electronic devices, according to CNBC.

Raul Grijalva, D-Ariz., Huffington Post reports.

"'We applaud your commitment to criminal justice reform and your administration’s work to address inequities in the criminal justice system and rectify the past wrongs of our government’s treatment of Native Americans,' they wrote. "Peltier, a 79-year-old Indigenous rights activist, has been in prison since 1977.

"An all-white jury convicted Peltier of murdering the two agents on South Dakota’s Pine Ridge Indian Reservation. He was sentenced to two consecutive life sentences.

"In 2021, tribal members sent a petition to Biden, asking for compassionate release or clemency.

"As Joe Biden prepares to leave office, he has a chance to do something singularly honorable in the name of American justice and basic human rights. With a grant of clemency to Leonard Peltier, Biden could ameliorate a half-century-old injustice not just against Peltier but, in effect, against Native peoples everywhere, many of whom consider Peltier an enduring symbol of racism and state-sponsored oppression in the US.

"For those Americans who may not have heard of him, Leonard Peltier is known around the world as the US government’s number one political prisoner. A member of the Chippewa and Lakota Nations, Peltier was convicted in 1976 for the deaths, the year before, of two FBI agents killed during a shootout on the Pine Ridge Reservation in South Dakota. While he was in the area at the time of the shootout, Peltier, who maintains his innocence, has served nearly 50 years and counting for a murder he was never proved to have committed – or even to have aided and abetted.

"It is widely understood that the federal government railroaded Peltier into prison by withholding and falsifying evidence, coercing witnesses and forcing a change of jurisdiction, among other acts of prosecutorial misconduct and malice. The US attorney James Reynolds, whose office handled the prosecution and appeal of the case, issued a public apology in 2021, acknowledging that the federal government failed to “prove that Mr Peltier personally committed any offense on the Pine Ridge Reservation”. Reynolds has since called on Biden to release Peltier.

"Reynolds’s statement alone should have been grounds for granting Peltier parole and ultimately clemency. Yet, despite multiple pleas over many decades, Peltier – who just turned 80 and is suffering from multiple health crises including diabetes, kidney disease, heart issues and near blindness – continues to languish in a high-security prison in Florida called Coleman 1."

"A core of activists in and around Leipzig – a city of around 600,000 in eastern Germany – has been gathering near the US Consulate to hold #VigilsForPeltier at regular intervals over the past decade.

"Bone-chilling winter temperatures did not stop participants from meeting Wednesday, nor were spirits dampened when the music stick – usually used to blast protest songs toward the villa housing the US diplomatic mission – broke.

"The lead local organizers, Elke and Holger Zimmer, are volunteers with TOKÁTA – LPSG RheinMain e.V. The group holds actions in cities around Germany in support of Peltier's freedom and is also involved in other #IndigenousSolidarity initiatives.

"The demonstrations are an opportunity to send a message to the US government and to engage with passersby about Peltier's cause. Volunteers have also been collecting signatures on a Europe-wide clemency petition, to be delivered to President Joe Biden before his White House term ends on January 20.

"The frequency of the now-monthly gatherings in Leipzig increased after former President Barack Obama left office in 2017. The Zimmers recall the hope, then shattering disappointment they felt when Obama declined to grant clemency to Peltier in his final days as president."

Mr. Peltier was convicted of murder in 1977 following a controversial investigation and trial, which many civil rights leaders and legal experts have called unjust, including the U.S. Attorney who prosecuted the case.

"In their letter, the lawmakers cite Mr. Peltier’s advanced age and illness, and stress that a presidential pardon is the last remaining hope for his freedom.

"'Despite the grave concerns surrounding the continued imprisonment of Mr. Peltier, who is now 80 years old and suffering from severe health conditions, including increasing vision loss, the Bureau of Prisons denied Mr. Peltier a compassionate release or reduction in sentence in April of this year; and in July 2024, the U.S. Parole Commission denied him parole. These recent denials mean only you have the unique ability to grant him clemency and rectify this grave #injustice that has long troubled #HumanRights advocates and #NativePeoples across the globe,' the lawmakers wrote.

"The lawmakers highlight the Biden-Harris administration’s unprecedented record of addressing the country’s history of injustices against Indigenous communities and urge President Biden to cement this legacy by commuting Mr. Peltier’s sentence.

BACKGROUND

"In 1977, Leonard Peltier was convicted of two counts of first-degree murder for the deaths of two FBI agents. His trial and conviction have been widely criticized by civil rights leaders and legal experts; key evidence was withheld, witnesses were coerced, and critical ballistics information was misrepresented. Mr. Peltier was an active member of the American Indian Movement (AIM), a grassroots movement founded in the late 1960s to organize activism around systemic poverty, discrimination, and police brutality against Native Americans. At the time of Mr. Peltier’s arrest, AIM was under deep scrutiny by the U.S. government.

"Last year, Ranking Member #Grijalva led a bipartisan, bicameral 33-member letter calling on President Biden and the U.S. Department of Justice to grant clemency to Mr. Peltier, as well as in October 2021 and February 2022. "Leonard Peltier’s story is one of profound injustice. Born in 1944 on the #TurtleMountainChippewa Reservation in North Dakota, Peltier grew up amid systemic neglect, poverty and the long shadow of federal policies designed to undermine Native sovereignty. By the 1970s, he had become a leading figure in the American Indian Movement (AIM), which fought to address the systemic injustices faced by Indigenous communities. This activism, however, placed him directly in the crosshairs of government surveillance and repression.

"On June 26, 1975, a shootout on the Pine Ridge Reservation in South Dakota left two FBI agents, Ronald Williams and Jack Coler, dead. The incident occurred against the backdrop of extreme violence and federal overreach on the reservation. Peltier, along with Robert Robideau and Darrelle Butler, was charged with the agents’ deaths. While Robideau and Butler were acquitted on grounds of self-defense, Peltier fled to Canada, where he was later extradited under false pretenses based on coerced testimony.

"Peltier’s trial in 1977 was marred by prosecutorial misconduct, including the suppression of key ballistics evidence that could have exonerated him. Testimony from Myrtle Poor Bear, a witness who later admitted she had been coerced by the FBI, was used to secure his extradition and conviction. Despite these glaring issues, Peltier was sentenced to two consecutive life terms. His imprisonment has since been widely condemned by #HumanRights organizations, including #AmnestyInternational, as well as legal experts and former law enforcement officials.

"Crucially, neither the judicial nor legislative branches sentenced Leonard Peltier to death or life without parole. Yet, through repeated parole denials, he has effectively been condemned to die in prison. This abuse of the parole system undermines the fundamental principles of justice and due process, particularly when significant flaws in his trial have been acknowledged by figures like Judge Gerald Heaney, who presided over Peltier’s appeal.

"Leonard Peltier’s continued imprisonment is not just about one man – it is a reflection of a justice system that fails to protect marginalized communities from systemic abuses. His case is a glaring example of how unchecked power and political motivations can devastate lives and perpetuate injustice."

The following statement from political prisoner Leonard Peliter was read at the 55th annual National Day of Mourning held in Plymouth, Mass., on Nov. 28, 2024.

"Greetings my relatives, friends, loved ones and supporters. I am honored that you still hold me in your thoughts, believe in me, pray for me and want to hear my words.

"It has been over 400 years since the settlers set out to 'civilize' us. They began by taking our blood, our children, to Spain. We were the first slaves in this 'great nation,' built on stolen land, with stolen lives and stolen labor.

"The king and queen of Spain fell in love with our children and tried to end the slavery of American Indians. The colonizers used every loophole they could find.

"They did not want to give up the stolen labor of our people. They moved on to the stolen lives of our Black brothers and sisters, torn from their homelands. Our blood, our sweat and our pain will forever bind us.

"The intent of the colonizers has always been total domination. When they could not control us, they killed us. They began with diseased blankets, bibles, bullets and lies they called treaties.

"Words are sacred. Our people know this, just as we know that Mother Earth herself lives and breathes through us.

"The words of the colonizers mean nothing, and their sacred pieces of paper mean less. Their 1868 Fort Laramie Treaty promised us an end to their wars against us and gave us the womb of Mother Earth, the Black Hills.

"They took our sacred land, and the genocidal fervor of the imperialists continues to this day. Their tactics have changed, but they want to see us annihilated as a People and steal what remains of our traditional land.

"Sitting Bull said, 'Possessions are a disease with these people.' They take. They ravish Mother Earth. It will never be enough, because they are hollow. They have an insatiable thirst for possessions and vengeance. I ask myself why they hate us so. Perhaps they know we do not need possessions.

"Our spirit cannot be broken, because we are all one. We are born of Mother Earth, woven with love, dignity and a freedom they cannot comprehend.

"Though they have entombed me in concrete and steel, I am a free man. They rounded up our people and put us in concentration camps they call reservations,

"We remain a free people.

"The true shackles are those caging the souls of those who oppress us. Perhaps they know. Their pitiful attempts to crush us turn back on them and take their humanity.

"With every attempted 'conquest,' they lose more of their spirit. Those who seek to oppress believe they are winning something. I ask them to open their eyes and look hard at what they think they have won.

"We. Will. Endure. They cannot take the sacred fire we carry. Do not let them take our children. They started with boarding schools. Now, it is the insanity they call government.

"They want to govern us out of existence. Give your children tradition, education, artwork, something to turn to besides the disease of drugs and alcohol that infects our reservations. Prayer is action, my friends.

"Tell your children who we are with every word you speak and every move you make. We are the First People. Mother Earth births us, fires the blood that runs through our veins and then takes us back into her womb. They can never take that from us.

"I have been warning for five decades now of the threat we face from the oppressors. Fascism has spread through those who have taken power and is staining the earth blood-red.

"What I stated in 1982 stands true. The forces of liberation must and shall come together to fight as a united front in unity of the four colors.

"I am proud of my heritage. I take pride in our people. Even when they believe they have stripped us of everything, we know the ground beneath us is ours to stand on, holding the blood and bones of our ancestors. We are rich in tradition in a way the settlers cannot perceive.

"Perhaps they know. Perhaps they hate us because we exist within the forces of nature. They have no dominion over the wind. We must not alienate those who stand on the right side of history. We all bleed red.

"We must stand together in solidarity to defeat the forces that would see all of us in shackles. And — I am still in prison. Again, I send my love and blood as a prisoner of war within the belly of the beast to those who continue the struggle.
