Justice Alito was the only sitting justice to request an extension.</p><p>"These disclosures are the first to be released since the Court announced its adoption of a Code of Conduct (Nov. 2023) and the first since the Pulitzer Prize-winning investigation from ProPublica was published (Apr. 2023&amp;ff). Given the wide array of data in the reports, it’s difficult to ascertain whether recent ethics scandals have changed the justices’ behavior. The act has been invoked three times in U.S. history, each time during wartime, and is meant to counter the actions of foreign governments and regimes, not alleged criminals, gangs, or non-state actors. The law was also used to justify Japanese internment during WWII, and now, the Trump administration is using it to justify its deportations. <br>In an unsigned opinion, the Supreme Court tossed a district court decision that had temporarily blocked President Trump’s attempt to continue using the 227-year-old law after he sent almost 300 Venezuelan migrants to a notorious prison in <a href="https://kolektiva.social/tags/ElSalvador" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>ElSalvador</span></a>, known for human rights abuses.</p><p>"All nine justices agreed, however, that anyone the administration is seeking to deport under the Alien Enemies Act must receive notice of deportation and be given the opportunity to challenge the removal through '<a href="https://kolektiva.social/tags/habeas" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>habeas</span></a> petitions' — meaning that migrants have the right to have their detention or deportation reviewed by the federal court, but only for themselves and in the area where they are being detained. </p><p>"The court’s three liberal justices dissented from the ruling, while Justice <a href="https://kolektiva.social/tags/AmyConeyBarrett" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>AmyConeyBarrett</span></a>, who was appointed by Trump, partially dissented. Even when Capitol Hill is not mired in deep dysfunction, the speed at which Congress and the courts operate no longer seems suitable for modern life. Both industry and ordinary people look to the administrative state, rather than legislators, for an immediate answer to their problems. Admin law is not always interesting, but the simple fact is when it comes to the day-to-day, agencies are the most impactful part of the federal government. NRDC. The Supreme Court ruled in favor of Chevron, allowing the <a href="https://kolektiva.social/tags/RonaldReagan" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>RonaldReagan</span></a> administration’s <a href="https://kolektiva.social/tags/industry" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>industry</span></a>-friendly Environmental Protection Agency to stick with a lax interpretation of the <a href="https://kolektiva.social/tags/CleanAirAct" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>CleanAirAct</span></a>.</p><p>"Over the years, Chevron deference has enabled federal agencies to tackle all sorts of issues that legislators have yet to cover — from addressing greenhouse gas emissions causing climate change to regulating broadband access. As the conservative legal movement to disempower the administrative state grew, Chevron deference became — in certain circles — shorthand for <a href="https://kolektiva.social/tags/GovernmentOverreach" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>GovernmentOverreach</span></a>.</p><p>"Before its decision to overturn Chevron, the Supreme Court had already dealt a blow to federal agencies’ regulatory authority by strengthening the 'major questions' doctrine in its 2022 decision in West Virginia v. EPA. According to the major questions doctrine, a federal agency shouldn’t have the leeway to craft regulation on an issue of major national significance if Congress hasn’t explicitly allowed it to do so in legislation. </p><p>"The same bloc of six <a href="https://kolektiva.social/tags/conservative" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>conservative</span></a> justices that formed the majority in West Virginia v. governmental discrimination because of their belief that marriage is the union of one man and one woman'.</p><p>"This directly relates to the cases currently being considered by the Supreme Court,
