![I am writing to you out of urgent concern that the UK government is placing itself in breach of European human rights law.
As you will be aware, the Equality and Human Rights Commission has issued a press release calling for trans people to be segregated in public facilities such as toilets and changing rooms. This is an astonishing reversal of decades of common practice and law.
When North Carolina enacted a similar law in 2016, the UK government issued travel guidance warning LGBT travellers to exercise caution. [1] It was widely seen as an extreme attack on human rights. The EHRC guidance will also be understood internationally as an attack on human rights.
The first trans rights legislation in the UK was a 1999 amendment to the sex discrimination act. Transgender people have always used the appropriate toilets and changing rooms, but since 1999 the courts understood them to be legally protected in doing so at work. Labour's 2010 Equality Act was understood as extending this protection to environments outside the workplace.
In 2004, the Labour government enacted the Gender Recognition Act, as it had been required to by the European Court of Human Rights. ![These are fundamental human rights because it is not possible to live a life without using toilets in public places, nor is it just to require trans people to out themselves by using separate facilities. That violates their right to a private life, it makes it impossible to live normally, and it opens them to harassment and violence.
I am sad to say that a Labour government that many of us had hoped would be a relief from the years of Tory rule has instead allowed the first anti-LGBT changes to law and practice since Margaret Thatcher's Section 28 (or 2A here in Scotland).
* Transgender adolescents have had their healthcare withdrawn, based on the Cass Review, which has been condemned internationally as inadequate and biased. [2]
* Transgender adults have lost rights from a Supreme Court reinterpretation of legislation that overhauls 15 years of understanding, including the understanding announced to parliament by ministers and civil servants when the legislation was introduced, and the understanding given in the explanatory notes. [3]
