WINNEMUCCA, Nev. (KOLO) - "Six protesters being sued by the Lithium Nevada Corporation are using what they are calling a 'biodiversity necessity defense'.

"They say the defense is 'a legal argument used to justify breaking the law when a greater harm is being prevented; for example, breaking a car window to save an infant locked inside on a stifling hot day, or breaking down a door to help someone screaming inside a locked home. In these cases, trespassing is justified to save a life.'

"This week’s filing states that the 'Defendants possessed an actual belief that their acts of protest were necessary to prevent the present, continuing harms and evils of ecocide and irreversible climate change.'

"'We’re in the midst of the 6th mass extinction of life on Earth, and it’s being caused by human activities like mining,' said attorney Terry Lodge, who is representing the protesters. 'Our lives are made possible by biodiversity and ecosystems. Protecting our children from pollution and biodiversity collapse isn’t criminal, it’s heroic.'

"In a filing with the court, Lodge and other attorneys claimed the company had 'unclean hands', and that Lithium Nevada has 'engaged in serious misconduct including violating the Defendants’ human rights, Defendants’ civil rights, misleading the public about the impacts of lithium mining and how lithium mining contributes to climate change and biodiversity collapse, and conducting the inherently dangerous and ecologically destructive practice of surface mining at the Thacker Pass mine'.

"They further argue stopping the mine will prevent significant greenhouse gas emissions, and that their actions are justified because they are working to prevent #CimateChange."

"As of the writing of this pamphlet, the climate necessity defense has succeeded only once, in the United Kingdom in 2008. Although it hasn’t yet worked in the United States, there’s good reason to think it will soon.

"As described earlier, an activist attempting a climate necessity defense will plead not guilty to her charges and will notify the judge that she wishes to present a necessity defense. The judge will decide as a matter of law whether to allow the activist to use the defense — that is, whether the criminal statute under which the activist has been charged allows the necessity defense at all, and whether a reasonable juror could possibly find the defense to be valid (step 3). Because judges enjoy a wide range of discretion at this stage in the criminal process, most attempts at the necessity defense have failed here, before the jury ever hears the activists’ arguments.

"So keep this in mind: the climate necessity defense is a novel legal tool that hasn’t yet succeeded in any court in the United States.

"But there’s cause for hope. In the past, activists have been found not guilty by reason of necessity for protesting issues like #NuclearWeapons, #CIA recruitment, and #apartheid. Once they were able to describe their civil disobedience to a jury, protesters were often able to prove that their minor crimes of trespassing or disorderly conduct were justified in light of the serious injustices that they were facing. But in each case, it took the courts several years to catch up to public opinion and to allow the activists to present their necessity arguments to a jury. WINNEMUCCA, Nevada — "A judge has dismissed an “unjust enrichment” charge filed against seven people sued for protesting the Thacker Pass lithium mine in Nevada, but allowed five other charges to move forward.
District Judge Michael R. Montero rejected #LithiumNevada Corporation’s claims that protesters had engaged in unjust enrichment by writing online messages encouraging supporters to donate, ruling that these messages are '#ProtectedSpeech under the #FirstAmendment.'

"'This is a very significant win for my clients and a rebuke to Lithium Nevada,' says Terry Lodge, an attorney representing six of the protesters. 'But,' Lodge says, 'we’ve still got a long way to go in this case.'

"While one portion of Montero’s ruling was favorable to the protesters, other portions were not. Judge Montero issued a prelimary ruling in Lithium Nevada’s favor on five other claims. But, Lodge says that at this stage, the judge was not determining whether Lithium Nevada’s claims are true or not. He was simply reviewing Lithium Nevada’s allegations, taking them as true, and determining whether those allegations were violations of Nevada law.

"In another part of his ruling, Judge Montero called arguments that a #Paiute protester has a right to access the September 12, 1865 #ThackerPass massacre site within Lithium Nevada’s mine site to pray for massacred Paiute #ancestors 'frivolous'.

"The ruling states that recognizing traditional native land claims 'would unequivocally undermine each and every property owner’s rights' and concludes that '[t]his is a Pandora’s box the Court is unwilling to open.”
The defendants are seeking monetary donations to their legal defense fund."

"Indigenous peoples around the globe agree that their health and the health of the planet are interdependent and in jeopardy. On day two of the United Nations Permanent Forum on Indigenous Issues, or UNPFII, this fact — that Indigenous people make up 5% of the world’s population but are responsible for 80% of its biodiversity — was repeated again and again by global Indigenous leaders.

"'As we are all aware, Indigenous peoples have least contributed to the problems of climate change nonetheless, due to their interdependence with their vital environment in their ecosystems, they suffer at its worst effects,' said Francisco Cali Tzay on Tuesday, a #Mayan #Cakchiquel from #Guatemala and the UN Special Rapporteur on the rights of Indigenous peoples. The Special Rapporteur keeps tabs on Indigenous peoples globally and reports back to The United Nations Commission on Human Rights on best practices.

"This year’s theme: human health, planetary and territorial health, and climate change gave attendees an opportunity to talk about the shortcomings of governments and non-Indigenous leaders. Others called upon the Permanent Forum to take action.

"#SanCarlosApache Tribal Chairman, Terry Rambler, drew attention to a “major human rights violation” happening at #OakFlat, a sacred area within #Arizona’s #TontoNationalForest where #ResolutionCopper — a joint venture of two mining giants #BHPBilliton and #RioTinto — seeks to develop one of the largest #CopperMines in North America.

"'Apache people have lived, prayed and died at Oak Flat from time immemorial,'
Rambler said. 'Every person by virtue of being human has the right to practice their religion. By violating the rights of Apaches to practice our religion and maintain our spiritual health and wellbeing, the United States is failing to comply with international standards incumbent on them.'

"#Sámi youth from #Finland, #Sweden and #Norway called upon the Permanent Forum to urgently turn their attention to green transition projects in #Sápmi, the traditional territory of the Sámi, which stretches across the Nordic countries and into Russia.

"'In the name of saving the planet, the Nordic states are digging into our #mountains, drilling holes into our rocks, and making it impossible for Sámi to practice our #traditional livelihoods,' said Elle Rávdná Näkkäläjärvi, a spokesperson for the delegation. 'What is being shown to the world as a shift to sustainability is just #Nordic #colonialism hiding behind a new kind of mask.'

"In 2021, Norway’s Supreme Court stripped the operating license of the Fosen Vind project on Norway’s west coast after ruling it was built illegally and violated the Sámi’s human rights, and in January, a Swedish state-owned mining company found 'vast amounts of #RareEarthMinerals' it could mine to decrease dependency on #China. That mining, however, would 'devastate the local Sámi community,' the Sámi youth said.

"'We demand the Nordic states to immediately halt the ongoing human rights violations against the Sámi,' they said. 'We plead the global Indigenous community to notice this green colonialism.'

"The #GlobalIndigenousYouthCaucus — composed of Indigenous youth from all seven regions within the UN — also made waves on Tuesday, calling on the Permanent Forum and the General Assembly to assist in perpetuating ancestral knowledge by enforcing an intergenerational Indigenous advisory group for bodies of the United Nations. That advisory group could share and apply #TraditionaKnowledge and #IndigenousMethodologies within UN agencies, such as the World Health Organization.

"'Environmental destruction not only contributes to #ClimateChange , but also impedes on our ability to access to traditional knowledge, traditional medicines, sacred sites, and traditional practices,' The Global Indigenous Youth Caucus spokesperson said. 'As Indigenous youth, we are future bearers of knowledge, and we hold both the knowledge of our ancestors, and our descendants.'

"Indigenous Rights Governance partner at the New Zealand Human Rights Commission, Claire Charters, gave an intervention about the disproportionate risks #Māori people are facing in a changing landscape.

"'We must ensure that Māori are centered in the discussions on mitigation and adapting to climate change, and that Indigenous knowledge is more deliberately considered,' Charters, who is Māori, said. 'Climate change is accelerating the severity and frequency of major weather events. We must act with urgency to understand the risks and minimize the impact on our lands, territories, cultural infrastructures, and the overall well being of our Indigenous communities.'

"Climate will remain a central theme in the upcoming days of the UNPFII. Tomorrow, the Native Women’s Association of Canada will host a session on 'Indigenous Women’s Perspectives On the Burning Issues of Climate Change', and the International Indian Treaty Council will join with other Indigenous Peoples Organizations to discuss the contentious conservation goal of 30×30 and how it violates the rights of Indigenous Peoples."

RENO, Nev. (AP) — "Federal wildlife officials have agreed to conduct a full, year-long review to determine whether a tiny #snail found only in high-desert springs near a huge lithium mine being built along the #Nevada- #Oregon line should be listed as a threatened or #endangered species.

"The U.S. Fish and Wildlife Service said in a finding published Thursday in the Federal Register that enough scientific exists to warrant the review sought by environmentalists who say that groundwater pumping required for the operation of the #ThackerPass mine could push the #KingsRiver pyrg to the brink of extinction.

"However, the agency said in the new finding it 'does not anticipate the species is immediately at risk.'

"The @WesternWatershedsProject argued in its formal petition for the listing in September 2022 that the tiny snail no bigger than the tip of a ball-point pen was imperiled even before any new mining was contemplated due to livestock grazing, round-building and the anticipated impacts of #ClimateChange."
